Most Frequent Reasons for UK Visa Refusal from Pakistan

Although the reasons for UK Visa Refusal from Pakistan are many; however, these can be summed up in the following three (3) broad categories:

Changes in the Immigration Rules

Importantly, both in 2008 and 2015 substantial changes in the Immigration Rules were instituted and during both these years, the visa success rate remained lowest i.e. 57.46% and 53.66%. This can be attributed to a lack of immediate understanding of the Changes to the Immigration Rules and their implications on the outcome.

Lack of Proper Documentation

By and large, especially in visitor visa applications, most of the applicants do not document visa application in a befitting manner, therefore, makes it quite impossible for ECO to grant a Visa.

Inappropriate Immigration Advice and UK Visa Refusal

Most of the applicants never give importance to proper advice as they are never able to understand the legal intricacies that are involved in submitting a befitting application for grant of a UK visa. Accordingly, they give heed to ill advice by consultants or amateur application filers, who does not have a proper grapple on a visa application and representation.

UK Visa Refusal Pakistan: Reapply, Appeal, Judicial Review

After UK visa refusal an applicant can reapply, especially after a UK visitor visa refusal. Moreover, there is no specified time limit for reapplying after refusal. Perhaps, an applicant can reapply even within a week’s time. However, a reapplication should address the refusal reasons and substantiate the reapplication with appropriate evidence. Certainly, there is no point reapplying without proper homework.

UK Visa Refusal from Pakistan: Appeal or Judicial Review

If the refusal letter provides for a right to appeal then an applicant can lodge an online appeal. Moreover, the IAFT 6 appeal form is for lodging an appeal against entry clearance refusal.  The IAFT 6 appeal form is for filing an appeal against entry clearance refusals such as spouse visa, EEA, human rights and asylum claim refusal.

Challenge UK Visitor Visa Application Refusal

Perhaps, UK visitor visa applications from Pakistan accounts for more than 80% of the total visa applications. However, there is no right of appeal against a visitor visa refusal. The right to appeal against a family visitor visa also abolished in 2015. Therefore, apart from a reapplication, the only other alternative is to file a judicial review.

Judicial Review for UK Visa Application Refusal

The points-based applications under Tier 1, Tier 2 and Tier 4 provide for an administrative review (AR) after refusal. However, AR is a pair group review and chances of overturning a decision are not more than 10%. Therefore, if an applicant thinks that the decision is not appropriate then can opt for a judicial review. Perhaps, unlike a visitor visa application, in case of a PBS application. at times it is not expedient to reapply after a refusal. However, going for a reapplication or judicial review entirely depends on the merits of the case and requires a specialist legal advice.
